Terms & Conditions

The following guidelines, which take effect on October 1, 2008 apply to all applications submitted in connection with the Open Skies Recreational Vehicle Insurance Program in British Columbia for ATV's Snowmobiles & Trail Bikes offered by Oasis Outdoor Adventure & Sport Insurance Solutions Inc. As is true with any guidelines, they cannot be all encompassing. It still requires a conscientious effort on the part of the broker of agent to determine if a given risk qualifies for this program. While an account may qualify according to the letter of these guidelines, the broker or agent must determine if the degree of exposure is greater than would be expected and the account should be referred for special terms and conditions.

1. Maximum Policy Term

The maximum policy term allowed under any policy is 12 months.

2. Classes of Business

All recreational use ATVs, Snowmobile Vehicles or Trail Bikes are eligible, provided they are not licensed for use on any public roadway or highway, or used in race or speed events or practice.

3. Territory

Only policy holders who reside in the province of British Columbia are eligible for coverage under the program.

4. Maximum Issue Limits

5. Coverage Forms Available

Physical Damage coverage with a base program deductible of $500 is available on All Perils, Comprehensive or Specified perils coverage forms.

Third Party Liability coverage is available with premiums applicable on a per unit basis with $1,000,000 limits and $2,000,000 limits available for ATVs and Snowmobiles, and $500,0000 limits available for Trail Bikes.

Please note that in the event of a claim where the operator is unlicensed, the coverage limit is reduced to $200,000 and a $1,000 property damage deductible becomes applicable.

Replacement Cost is available for ATVs and Snowmobiles only for up to 24 months as per the policy endorsement wording. Replacement Cost must be purchased within 120 days and inspections must be done if coverage has not been placed within 10 days of delivery. The unit must be insured for 100% of the original purchase price including all accessories and taxes where applicable. Replacement Cost is not available for Trail Bikes.

Actual Cash value is otherwise provided and is subject to 90% co-insurance.

Truck Decks and Trailers

The policy shall automatically provide coverage for the same physical damage perils purchased on the unit for a Truck Deck or dedicated Trailer used to transport the units or while in storage, subject to a limit of $1,000. This coverage limit can be increased at a rate of 3% for All Perils, 2.5% for Comprehensive and 2% for Specified Perils over the automatic limit. Either way the automatic limit or extended limit must be declared on the application. Coverage on the Truck Deck and Trailer must be the same coverage form as purchased on the recreational vehicle.

6 Minimum Premium per Policy is $50 Per Unit

7. Ineligible Applicants / Operators and Units

  1. Any USA domiciled REcreational Vehicle
  2. Any non-resident applicant or applicant without a British Columbia mailing address.
  3. Any Recreational Vehicle applicants/operators with more than six(6)demerit points on their drivers license at the time of application. If in doubt, the agent or broker must provide driver's abstract prior to binding coverage.
  4. Applicant/Operators with more than one (1) at fault accident in the past five (5) years from the operation of a any motorized vehicle.
  5. Applicants /Operators that have any Criminal Code Motor Vehicle related offences in in past three (3) years.
  6. Any Recreational Vehicle unit used for business purposes other than ranching or farming unless declared and approved by underwriters.
  7. Any ATV Unit with less than four wheels shall be rated as a Trail Bike.
  8. Any Recreational Vehicle unit that is not inspected unless coverage is replacing an expiring policy as demonstrated by providing a copy of the expiring policy declarations page. Exceptions allowed for new REcreational Vehicles purchased in the last 10 days as evidenced by a copy of the bill of sale (dealer demonstrator Recreational Vehicles and used Recreational Vehicles excluded) and for Recreational Vehicle policies where only liability insurance is purchased.

8. Referrals for Special Acceptance

Certain Applicant, Operators or Recreational Vehicle units must be referred to Echelon's designated underwriters prior to quoting policy terms.

  1. Any Applicant or Operator with more than one (1) not at fault accident, including comprehensive or specified perils, (windshield, vandalism, theft, etc).
  2. Any Recreational Vehicle unit with performance enhancing equipment modifications such as "turbocharged", nitro kits, suspension, special lugs or belts (on Snowmobiles) etc. A minimum of surcharge of 25% is applicable if approved for coverage.
  3. Any ATV or Snowmobile units that exceed $25,000in value including attachments.
  4. Any Trail Bike units that exceed $15,000 in value including attachments.
  5. Any request for backdating of coverage.
  6. Any Applicant who is not the registered owner or lessee of the Recreational Vehicle to be insured.
  7. Any ATV that has been modified for "track" use in the winter

9. Referral Submission Requirements:

In order to enable the Echelon designated underwriter to quickly review your referral request please provide full details of the business being evaluated including:

  1. A completed Open Skies REcreational Vehicle Program Application Form (see Appendix 2);
  2. The supporting documentation requested in the application form or as outlined in these guidelines;
  3. Any coverage or premium recommendations you may wish to make.

10. Underwriting Rules and Coverage Options

Binding of Coverage

Prior to binding coverage you are required to have all applicable documentation completed and on file. This includes a substantially completed and signed application with final documentation to follow within a week, a signed inspection form, a copy of the previous insurance coverage, a copy of the bill of sale if physical damage coverage is being purchased, and supporting documentation for any premium discounts being allowed. You cannot bind for over $25,000 in physical damage value on ATVs and Snowmobiles or over $15,000 on Trail Bikes. A completed application with details on the modifications must be submitted and accepted by Oasis Outdoor Adventure & Sport Insurance Solutions Inc. or Credit Union Insurance Services Association (CUISA) before coverage is bound. We will allow 10 days backdate coverage for renewing policies subject to receiving confirmation from the insured of no know losses during this backdated period.

Earning of Premiums, Cancellation - Minimum Retained

  1. Premiums are earned at 25% per month over the first four (4) months of the policy term.
  2. Minimum Retained Premium of $100 per policy.
  3. No backdating of cancellation if policy is cancelled for non-payment. Minimum Retained or earned premiums are payable in all cases.

Premium Discounts Requirements

Provincial Association Membership or Member Club Pricing ("Member Pricing")

A copy of the membership form applicable to each applicant and/or operator must accompany the coverage application. Membership rates are applicable for immediate family members residing at the same home address. Please note that Association or Club Membership is only applicable on the insurance premiums for the type of recreational vehicle insured. i.e an ATV membership does not qualify for a snowmobile discount, or vice versa. To receive the applicable discount on all types of Recreational Units, each applicant and operator must be a member (or immediate family member residing in the same residence) of the appropriate provincial organization.

Additional 10% Rider Training Course - Three Year Claims Free Discount

A 10% premium discount is available to the premium applicable to each applicant and/or operator that has completed an approved training course and has been claims free for three (3) consecutive years. The applicant's previous insurance policy is required to support their statement of a three year term of continuous claims free recreation vehicle coverage. This discount in not available on Trail Bike premiums.

A copy of a certificate or card indicating the successful completion of an ATV Safety Course or a snowmobile Safe Operators Certificate available to each applicant an/or operator must accompany the coverage application. Please note that the discount in only applicable on the insurance premiums for the corresponding type of recreational vehicle insured that is operated by the holder of the certificate or card.

11. Claim Procedures

If the Broker receives notice of loss from the insured it MUST be forwarded directly to Gold Claims Service at the contact numbers provided above.
